These Terms of Service ("Terms") govern your use of Donna (the "Service"), provided by iCube Lab / iCubemedia Inc. ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

Free Plan: Limited access with usage caps (15 clients, 20 appointments/month, 1 staff member, 6 services, 10 inventory items).

Paid Plans (Starter, Professional, Enterprise): Billed monthly via Stripe. You may cancel at any time. Cancellation takes effect at the end of the current billing period.

Refunds: We offer a 30-day money-back guarantee on first-time subscriptions. Contact support within 30 days for a full refund.

You retain ownership of all data you enter into the Service. We do not claim any intellectual property rights over your content. You grant us a limited license to host, store, and process your data solely to provide the Service.

You may export your data at any time using the built-in export features. Upon account deletion, we will remove your data within 30 days.

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with prior notice. We are not liable for downtime caused by factors beyond our control.

The Service integrates with third-party services including Stripe, Square, Google Calendar, and additional telephony, messaging, and email-delivery providers. Your use of these integrations is subject to their respective terms of service. We are not responsible for third-party service availability or data handling.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time through the Settings page or by contacting support. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms shall be governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Montreal, Quebec.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the revised Terms.
